Resolution No. 020-05 — All Terrain Vehicle Safety

WHEREAS, The Stockbridge-Munsee Community, Band of Mohican Indians, is a federally recognized Indian tribe with inherent sovereign powers, and is governed by the Stockbridge-Munsee Tribal Council pursuant to the 1937 Constitution; and,

WHEREAS, The Stockbridge-Munsee Community has the authority under its constitution and its inherent rights as a sovereign nation to adopt and amend Ordinances; and,

WHEREAS, The Tribal Council adopted Chapter 47-A, the ATV Safety Ordinance on August 8, 2000; and,

WHEREAS, The Tribal Council desire to amend Chapter 47-A to include other residential areas as safety zones, protect the gravel shoulders on roads from damage, to limit the class of individuals who can operate ATVs, to regulate the use of alcohol by operators, and to require that ATV's be registered with Public Safety.

NOW THEREFORE BE IT RESOLVED, that the Stockbridge-Munsee Tribal Council hereby adopts the following amendments to Chapter 47-A: Sections 47-A.3; 47-A.4(F); 47-A.5(E); 47-A.5(E)(5)(c); 47-A.5(E)(6)(a); 47-A.6(A); 47-A.6(B), (B)(7); (B)(7)(a); and creates Sections 47-A.5(A)(2); 47-A.5(C); 47-A.5(D); 47-A.5(E)(6)(b), (c), (d); 47-A.10.
