Resolution No. 049-15 — Public Peace and Good Order

WHEREAS, The Stockbridge-Munsee Community, Band of Mohican Indians, is a federally recognized Indian tribe with inherent sovereign powers, and is governed by the Stockbridge-Munsee Tribal Council pursuant to the 1937 Constitution;

WHEREAS, The Stockbridge-Munsee Community has the authority under its Constitution and its inherent rights as a sovereign nation to adopt and amend Ordinances;

WHEREAS, The Stockbridge-Munsee Tribal Council and Stockbridge-Munsee Police and Fire Commission desire to make substantial changes to clarify and improve the existing Chapter 16, Public Peace and Good Order Ordinance;

WHEREAS, The revisions to Chapter 16 include clarifying the language in sections, codifying Resolution 042-11 regarding concealed weapons, and adding new sections on jurisdiction and enforcement, as well as new violations for misappropriation, drug-related criminal activity, public intoxication, obstruction, nuisance, condemnation and abandoned buildings; and

WHEREAS, These changes have resulted in whole-scale changes to Chapter 16 that include adding new sections and the re-numbering, re-organizing and revising existing sections.

NOW THEREFORE BE IT RESOLVED, that the Stockbridge-Munsee Tribal Council hereby repeals the existing version of Chapter 16 and adopts the revised document that includes the recommended changes as a new Chapter 16, the Public Peace and Good Ordinance.
