Resolution No. 054-15 — Exclusion

WHEREAS, The Stockbridge-Munsee Community is a federally-recognized Indian tribe with inherent sovereign powers and is governed by the Stockbridge-Munsee Tribal Council pursuant to its 1937 Constitution, as amended;

WHEREAS, The Stockbridge-Munsee Community has the authority under its Constitution and its inherent rights as a sovereign nation to adopt and amend ordinances, including for the exclusion of nonmembers from its territory;

WHEREAS, The majority of the tribal electorate indicated that they would support an ordinance providing for the exclusion of persons who are not members of the Tribe from the reservation as part of an advisory referendum on the ballot of the regularly-scheduled tribal election on October 11, 2014;

WHEREAS, The Tribal Council finds that an ordinance to exclude nonmembers, who are a danger to the community, from tribal lands is necessary to protect the social, economic and political welfare of the Tribe, its members and its lands;

WHEREAS, The proposed Exclusion Ordinance establishes grounds for the exclusion of non-members from tribal lands, as well as the process that will be in relation to such exclusions; and

WHEREAS, The proposed ordinance also codifies the Tribe's practice of providing for temporary bans from tribal buildings and premises in order to best provide for the safety and security of the tribal community and tribal resources.

NOW THEREFORE BE IT RESOLVED, that the Stockbridge-Munsee Tribal Council hereby adopts a new Chapter 68, Exclusion Ordinance, as part of Stockbridge-Munsee tribal law.
