Resolution No. 02-16 — Gaming

WHEREAS, The Stockbridge-Munsee Community, Band of Mohican Indians, is a federally recognized Indian tribe with inherent sovereign powers, and is governed by the Stockbridge-Munsee Tribal Council pursuant to the 1937 Constitution;

WHEREAS, The Stockbridge-Munsee Community has the authority under its Constitution and its inherent rights as a sovereign nation to adopt and amend Ordinances;

WHEREAS, The Tribe is authorized to conduct gaming activities on the Stockbridge-Munsee Reservation in accordance with federal gaming law and its Gaming Compact with the State of Wisconsin;

WHEREAS, The Tribe regulates such gaming activities through Chapter 25, the Gaming Ordinance, which was approved by National Indian Gaming Commission as required under federal law;

WHEREAS, Revisions to Chapter 25 were identified that included changes to the definitions of ancillary facility, key employees and primary management officials, additional language for addressing disputes in relation to changes to operating procedures, additional bases for suspension or denial of a gaming license, among others contained in the attached version of the Revisions showing all additions and deletions;

NOW THEREFORE BE IT RESOLVED, the Stockbridge-Munsee Tribal Council hereby adopts the amendments to Chapter 25 that were presented to the Tribal Council at its meeting on October 6, 2015;

BE IT FURTHER RESOLVED, the Stockbridge-Munsee Tribal Council directs that the amendments to Chapter 25 adopted at its meeting on October 26, 2015 be forwarded to the National Indian Gaming Commission for approval pursuant to 25 U.S.C. § 2710(e).
