Resolution No. 025-18 — Tribal Court Code

WHEREAS, The Stockbridge-Munsee Community is a federally recognized Indian tribe with inherent sovereign powers and is governed by the Stockbridge-Munsee Tribal Council pursuant to the 1937 Constitution, as amended;

WHEREAS, The Stockbridge-Munsee Community has the authority under its Constitution and its inherent rights as a sovereign nation to adopt and amend Ordinances;

WHEREAS, Chapter 49, the Election Ordinance, establishes the system that the Tribe uses to conduct impartial and equitable elections;

WHEREAS, In an advisory referendum held as part of the 2017 election, the majority of voters supported the addition of a primary election to the annual election cycle;

WHEREAS, Along with adding a primary election, the Tribal Council wishes to update Chapter 49 to add a contested ballot process, clarify that the ordinance is used as guidance for conducting recall elections and address how election appeals are handled by the Election Board and Tribal Court;

NOW THEREFORE BE IT RESOLVED, the Stockbridge-Munsee Tribal Council hereby adopts the amendments to Chapter 49, which make the following changes:

• Amended sections: Introduction, 49.1(A), (D), (E); 49.2; 49.3; 49.5; 49.6(A), (B), (C), (D), (E)(3); 49.7; 49.8(A); 49.9(A), (D); 49.11(A); 49.11.5(B); 49.11.7(A), (C); 49.12(A)(3), (B), (B)(1), (B)(1)(a-b), 49.12(B)(2)(c-d), (B)(3); 49.12.5 (B), (C), (D), (E), (F); 49.16(A), (B), and (C).
• Added new sections: 49.1(A)(3-4); 49.6(B)(1-2); 49.6(D); 49.6(E)(1),(2), (3)(i-ii) and (4); 49.6.5; 49.8(R)(3)(a-b); 49.8(U); 49.8.5; 49.11(A)(1-2); 49.12(B)(2), (4), (5); 49.12.5(A), (E)(1-2), (F)(1-5), (G), (H); 49.12.5(G); 49.16(D); and 49.19.
• Reordered sections: 49.12 (A) and (B).
• Deleted section: 49.12(A)(7).
