Resolution No. 026-18 — Tax

WHEREAS, The Stockbridge-Munsee Community is a federally recognized Indian tribe with inherent sovereign powers and is governed by the Stockbridge-Munsee Tribal Council pursuant to the 1937 Constitution, as amended; and

WHEREAS, The Stockbridge-Munsee Community has the authority under its Constitution and its inherent rights as a sovereign nation to adopt and amend Ordinances; and

WHEREAS, Chapter 57, the Construction Sales Tax Ordinance, was adopted in 1990 by Tribal Council resolution and has not been amended since; and

WHEREAS, Chapter 57-A, the Room Tax Ordinance, was adopted in 2010 by Tribal Council Resolution and has not been amended since; and

WHEREAS, The proposed revisions to Chapter 57 have been posted for public comment for thirty (30) days and no comments were submitted; and

WHEREAS, The authority to enact a sales tax is vested in the Stockbridge-Munsee Community by its Constitution and By-Laws, and particularly by Article VII, Powers; and

WHEREAS, The revised Chapter 57 Tax Ordinance establishes a comprehensive tribal tax regime that incorporates both a sales tax and a hotel occupancy tax, as well as the related administrative process.

NOW THEREFORE BE IT RESOLVED, the Stockbridge-Munsee Tribal Council hereby adopts the following amendments to Chapter 57 and 57-A which include the following changes:
