Resolution No. 042-21 — Fish and Wildlife

WHEREAS, The Stockbridge-Munsee Community is a federally recognized Indian tribe with inherent sovereign powers and is governed by the Stockbridge-Munsee Tribal Council pursuant to the 1937 Constitution, as amended;

WHEREAS, The Stockbridge-Munsee Community has the authority under its Constitution and its inherent rights as a sovereign nation to adopt and amend Ordinances;

WHEREAS, The Tribal Council has adopted the Fish and Wildlife Ordinance, Chapter ENV.01, formerly known as Chapter 21;

WHEREAS, Revisions to the Fish and Wildlife Ordinance have been recommended, which include changes to turkey fees, seasons, bag limits, hunting by minor-aged permittees, moving responsibilities from Land and Enrollment to the Conservation Department, new requirement for blaze orange or hot pink clothing during Wisconsin gun deer season, ammunition requirements, bear baiting, trapping requirements, protection of antlerless elk and moose, and updated language on taking of bear and wolves that are threat to human safety for consistency.

NOW THEREFORE BE IT RESOLVED, that the Stockbridge-Munsee Tribal Council hereby adopts the following revisions to the Fish and Wildlife Ordinance:

• The addition of the following new subsections in ENV.01: 08(a)(4); 10(d); 12(c)(2-5); 13(b)(4)(D and E); 13(b)(5); 14(c)(4); 22(i); 22(j); and 27(d).
• The revision of the following subsections in ENV.01: 03(f); 03(j); 08(b); 08(c)(3); 09(a); 09(b)(3); 09(c); 10(b)(1)(A and B); 10(c)(3); 12(a)(2); 12(c)(1); 13(b); 13(b)(3); 13(b)(4)(A and B); 14(c)(2 and 3); 17(c)(8); 18(a)(1 and 2); 19(a)(3); 19(b); 19(c)(1 and 4); 19(e); 22(c); 26(c)(3); 27(c); 27(e); 29(a); 29(d)(4); and 29(d)(8).

CERTIFICATION

I, the undersigned, as Secretary of the Stockbridge-Munsee Tribal Council, hereby certify that the Council is composed of 7 members, of whom 7, constituting a quorum, were present at a meeting duly called, noticed, and held on the 3rd day of August, 2021, that the foregoing resolution was duly adopted at such meeting by a vote of 4 for, 2 against, and 0 abstaining.
